Terms of Service

These Terms of Service ("Terms") govern your use of the NumBan mobile application and the numban.com website (collectively, the "Service") operated by NumBan ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent that you have the legal capacity to enter into a binding agreement.
2. Account Registration
You must create an account to submit reports. You can register using your email address, US mobile phone number, or Apple ID. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately at support@numban.com if you suspect unauthorized access to your account.
3. Permitted Use
NumBan is a consumer tool for reporting unwanted or scam voicemails received on your own phone. You agree to:
- Only submit voicemails that you personally received
- Accurately confirm the callback number before approving a report
- Not submit false, fraudulent, or misleading reports
- Not use the Service to harass, defame, or target any individual or business
- Not attempt to circumvent verification, rate limits, or other security measures
- Not use automated tools, bots, or scripts to interact with the Service without our written permission
- Not reverse engineer, decompile, or disassemble any part of the Service
4. Report Submission and Processing
4.1 Verification
NumBan cross-verifies callback numbers by comparing voicemail transcript metadata against an independent audio transcription. You are responsible for reviewing and approving the final report before it is submitted. Once you tap "Send," the report is queued for delivery to the carrier and cannot be recalled.
4.2 Carrier Abuse Reports
Approved reports are sent as abuse complaints to the carrier or Responsible Organization (RespOrg) identified as controlling the callback number. Reports are sent from a NumBan-managed relay email address. We do not guarantee that any carrier will act on a complaint.
4.3 Kill Tracking
We periodically re-check reported numbers to determine whether they have been disconnected. A "kill" is confirmed when a number becomes non-routable after reports are filed. Kill confirmation is automated and may not be immediate. We do not guarantee the accuracy or finality of kill determinations; a number may be temporarily disconnected and later reactivated.
5. Public Data
Reported numbers that meet our publication threshold may appear on public pages at numban.com. Public pages display aggregate, redacted data only: callback number, report count, carrier name, scam type, confidence level, and status. Your voicemail audio, transcripts, and personal information are never published.
Your display handle and kill count may appear on the public leaderboard. You can change your display handle at any time.
6. Intellectual Property
The Service, including its design, code, branding, and content, is owned by NumBan and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
By submitting a report, you grant NumBan a non-exclusive, royalty-free, worldwide license to use, store, process, and display the submitted data (including voicemail audio) for the purposes of operating the Service, generating abuse complaints, publishing aggregate statistics, and improving scam detection.
7. Prohibited Conduct
Violation of any of the following may result in immediate account suspension or termination:
- Submitting false or fraudulent reports
- Using the Service to target legitimate businesses or individuals
- Attempting to manipulate the leaderboard or kill counts
- Creating multiple accounts to circumvent enforcement actions
- Interfering with the operation of the Service or other users' experience
- Violating any applicable law or regulation in connection with your use of the Service
8. Account Suspension and Termination
We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms. We may also remove or suppress any content or data associated with a terminated account. You may delete your account at any time through the app settings, as described in our Privacy Policy.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Carrier information, scam classifications, or number lookup results will be accurate or complete
- Abuse complaints will be received, read, or acted upon by carriers
- Reported numbers will be disconnected or that kill confirmations will be accurate
- The Service will be available in all jurisdictions or at all times
NumBan is a consumer reporting tool, not a law firm. Nothing in the Service constitutes legal advice. If you believe you have a legal claim under the TCPA or other statute, consult a licensed attorney.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NUMBAN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising from or related to your use of the Service, including but not limited to:
- Loss of data, revenue, or profits
- Actions taken by carriers in response to abuse complaints
- Inaccurate carrier lookups, scam classifications, or kill determinations
- Unauthorized access to your account
- Any third-party conduct on or through the Service
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
11. Indemnification
You agree to indemnify, defend, and hold harmless NumBan and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Dispute Resolution
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to the personal jurisdiction of such courts.
13. Modifications
We may modify these Terms at any time by posting the updated version with a new "Last updated" date. Material changes will be communicated via the app or email. Your continued use of the Service after the effective date of any modification constitutes acceptance of the revised Terms.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NumBan regarding the Service and supersede all prior agreements and understandings.
